Q: Hi I have worked for the company for 3 years and I was placed on part time (3 days a week) last June,following a 5 month lay off period. Again I was placed on lay off 4 weeks ago 1) Am I entitled to the 3 public holidays over the festive season 2)Will my redundancy (statory)be affected due to the lay off and reduction in hours. A: Your redundancy will be calculated based on the length of service which does not include periods of layoff but will include the part–time work service. 

Part III of the Organisation of Working Time Act, 1997 (the “Act”) sets out employees’ entitlements in relation to public holidays. 

The Act provides that all full-time employees are automatically entitled to public holiday benefits whereas part-time and casual employees must have worked at least 40 hours in the 5 weeks preceding the public holiday to qualify for public holiday benefits
