Q: I have been made redundent from my job, but my employer is bringing in agency people to do the same work, is this legal


A: This does not appear to be a genuine redundancy situation as the role continues to exist and the employer is engaging others to do it through an agency. 

Redundancy arises when a role no longer exists which does not appear to be the case in this situation. 

You can take a case to the Rights Commissioner once it is within 6 months since you were made “redundant”. In exceptional circumstances this can be extended to 12 months but best act within the six months time frame.
